Contract Advice and Dispute Resolution

Forms of procurement are constantly evolving and contracts can
be as simple or as complicated as we choose to make them. Advice on
the most appropriate form of contract early in the procurement
process will save both time and money. Parties can become
entrenched in contractual disputes and generally it is in the
interests of both parties to avoid costly legal action; expert
advice on dispute resolution can help to achieve this.
We offer contract advice; procurement strategy; risk transfer;
contract document preparation; contract administration; expert
advice and opinion; preparation of formal expert statements and
reports; acting as expert witness; all forms of dispute resolution,
including mediation, conciliation, adjudication, arbitration and
litigation.
We can handle the procurement of highway schemes from minor
junction improvements to motorway widening schemes for a variety of
clients from private developers to local authorities and government
agencies. We have implemented schemes using all forms of contract
including traditional remeasurement, Design & Build, Design
Build Finance and Operate (PFI) and ECC/Partnering/Early Contractor
Involvement. Work with the Highways Agency has helped to
develop many of these forms.
This knowledge has led to us advising clients on the most effective
form of procurement and has enabled us to act as expert witness and
to assist in resolving contractual claims and disputes.
Scott Wilson staff co-authored the ICE Arbitration Procedure
1997 and are also on the ICE Arbitration Advisory Panel. Scott
Wilson is experienced in alternative dispute resolution and is on
the lists of Arbitrators, Adjudicators, Conciliators and Dispute
Board Members maintained by ICE, CIArb, FIDIC and the Highways
Agency. We have experience of resolving disputes by mediation,
conciliation and the adjudication processes.
